Probate & Spanish Inheritance
We are specialists in dealing with Spanish Inheritance / Probate for English speaking clients, and have dealt with numerous cases over the last 25 years.
We will guide you step by step through a procedure that, whilst the complexity depends on many factors, the most important starting point is whether there is a Spanish Will or not. (Please read here about the convenience of arranging a Spanish Will). So, the first step will be to find out whether the deceased person signed a Spanish will or not, and of course this is something we can do for you, obtaining a Certificate of Last Will, issued by the Central Registry of Wills in Spain, which is always the first step in the process of accepting a Spanish inheritance (after obtaining a copy of the “Death Certificate”).
We will make sure that the exemption rates are correctly invoked on the inheritance deed and tax forms and we will ensure that the ruling of the European Court of Justice (of 3rd September, 2014), which sentenced Spain for discriminating non residents regarding inheritance tax exemptions, is correctly applied, allowing non-resident heirs from that date, to claim the same exemption rates as residents.
If you would like to receive a no-obligation quotation for our services, please fill out the following form providing us with some information about you case (locations and approximate value of the assets involved, availability of Will, etc) and we will get back to you immediately.
