Selling Property in Spain

Selling a property in Spain also involves a number of legal and tax requirements, particularly for non-resident owners. We advise sellers on the documentation required for the sale, outstanding liabilities, taxes and the procedures that need to be completed before and after the transaction.

We can review or prepare the necessary contracts, communicate with the buyer or the buyer’s representatives, deal with outstanding matters affecting the property and assist with the completion of the sale before the Spanish Notary. Before the Title Deeds Are Signed

  • Conducting thorough legal checks to identify any debts, liabilities, charges, restrictions or other issues affecting the property,
  • Checking the property’s registered ownership and legal status through the Spanish Land Registry,
  • Confirming the legal status of the property in accordance with local town planning regulations, including checking the First Occupation Licence where applicable,
  • Checking whether the property is eligible for a tourist rental licence, or reviewing the existing licence where one is already in place,
  • Negotiating with the vendor, buyer or developer,
  • Checking the reservation contract,
  • Drafting or reviewing private purchase or sale contracts,
  • Assisting with applications for NIE numbers,
  • Advising on the legal and tax costs associated with the transaction.

On the Day of Completion

We will be present at the Notary to ensure that the transaction is completed correctly and that the title deeds reflect the agreed terms and conditions. The Spanish Notarial system plays an important role in the completion of property transactions in Spain, and we will make sure that the legal documentation is properly reviewed before signing.

If you are unable to attend the completion in person, we can, where appropriate, act on your behalf and sign the title deeds under a Power of Attorney.

After Completion Before the Notary

  • Processing the relevant taxes, including tax refund applications where applicable,
  • Registering the title deeds with the Land Registry,
  • Arranging water and electricity supply contracts,
  • Changing the ownership details at the Town Hall for local rates and charges,
